1. Acceptance of Terms

By accessing or using the GymSweat mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Service Description

GymSweat is a fitness and workout tracking platform that provides:

  • Workout logging with detailed set, rep, weight, and RPE tracking
  • Customizable workout templates and scheduling
  • Performance analytics including load scores, ACWR, recovery metrics, and strength classification
  • Body weight, hydration, and injury tracking
  • AI-driven auto-regulation and coaching insights
  • Progress photos and exercise media
  • Cloud sync across devices

The Service is offered as a freemium product. Some features are available only to GymSweat Pro subscribers.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and not share them with others
  • Notify us immediately of any unauthorized use of your account
  • Maintain only one account per person. Creating multiple accounts to abuse free trials or promotions is prohibited.

You are responsible for all activity that occurs under your account. GymSweat is not liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Upload harmful, offensive, or inappropriate content, including but not limited to discriminatory, threatening, or sexually explicit material
  • Attempt to gain unauthorized access to the Service, other user accounts, or related systems
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated scripts, bots, or scrapers to access the Service
  • Abuse discovery or sharing features (e.g., spamming shared workout links, mass-creating fake profiles)
  • Interfere with or disrupt the integrity or performance of the Service

5. User-Generated Content

You retain all intellectual property rights to content you create within the Service, including workout templates, notes, and progress photos ("User Content").

By uploading User Content, you grant GymSweat a non-exclusive, worldwide, royalty-free license to use, display, and process your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

GymSweat does not claim ownership of your workout data, templates, or personal fitness information.

6. Content Moderation

GymSweat implements content moderation for publicly shared content (e.g., shared workout templates, community features). Our moderation process includes:

  • Flagging system: Users can flag content they believe violates these Terms.
  • Auto-hide threshold: Content that receives a threshold number of flags may be automatically hidden pending review.
  • Appeal process: If your content is removed, you may appeal the decision by contacting support@gymsweat.com. Appeals are reviewed within 5 business days.

We reserve the right to remove any content that violates these Terms or is otherwise harmful, at our sole discretion.

7. Subscriptions & Payments

GymSweat Pro subscriptions are managed through RevenueCat and processed via the Apple App Store, Google Play Store, or Paddle (for web purchases).

  • Free trial: New users may receive a 14-day free trial of GymSweat Pro. The trial begins upon subscription and does not require payment information upfront when purchased through the app stores.
  • Billing: Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled.
  • Cancellation: You may cancel at any time. Access to Pro features continues until the end of the current billing period.
  • Refunds: Refund policies are governed by the respective app store (Apple, Google) or payment processor (Paddle). GymSweat does not process refunds directly.
  • Price changes: We may change subscription prices with at least 30 days' notice. Existing subscribers will be notified before any price increase takes effect.

8. Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU and, for Italian consumers, the Italian Consumer Code (D.lgs. 206/2005, Art. 52–59).

The withdrawal period expires 14 days after the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g., email to support@gymsweat.com).

Exception for digital content: If you have expressly consented to the immediate provision of digital content (e.g., activating GymSweat Pro features) and acknowledged that you thereby lose your right of withdrawal, the withdrawal right does not apply (Art. 59, lett. o, D.lgs. 206/2005).

9. Health Disclaimer

GymSweat is not a medical device and does not provide medical advice.

The Service provides fitness tracking, workout analytics, and performance insights for informational purposes only. Features such as readiness scores, recovery metrics, load analysis, and coaching suggestions are based on general fitness principles and algorithms, not individual medical assessments.

You should:

  • Consult a qualified physician before starting any exercise program, especially if you have pre-existing health conditions
  • Stop exercising and seek medical attention immediately if you experience pain, dizziness, or discomfort
  • Not rely on GymSweat data as a substitute for professional medical advice, diagnosis, or treatment

GymSweat assumes no liability for injuries or health issues arising from the use of the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • GymSweat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits.
  • Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to GymSweat in the 12 months preceding the claim.
  • We do not guarantee uninterrupted or error-free operation of the Service. Temporary downtime for maintenance or updates may occur.

11. Termination

You may terminate your account at any time by deleting it through the app's Settings or by contacting support@gymsweat.com.

We may suspend or terminate your account at our discretion if:

  • You violate these Terms
  • Your account is used for fraudulent or abusive activity
  • You fail to pay applicable subscription fees after repeated notice

Upon termination, your right to use the Service ceases immediately. Local data on your device remains yours. Remote data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via:

  • In-app notification
  • Email to the address associated with your account
  • Updated notice on our website

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Italy and the European Union. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Italy.

For EU consumers: Nothing in these Terms affects your statutory rights under applicable consumer protection legislation, including the right to pursue claims in the courts of your country of residence.

Before initiating legal proceedings, we encourage you to contact us at support@gymsweat.com to attempt to resolve the dispute amicably.

In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr.
